• Choose who receives your assets: A will allows you to specify who you want to inherit your property and assets. This can include family members, friends, charities, or other beneficiaries.

  • Appoint a Personal Representative: A will also allows you to appoint a Personal Representative to handle your affairs after you pass away. Your Personal Representative will be responsible for distributing your assets, paying off any debts or taxes, and handling other administrative tasks related to your estate.

  • Provide for your loved ones: A will can also help ensure that your loved ones are taken care of after you pass away. You can specify who you want to provide for, and how much they should receive.

  • Minimize family disputes: Without a will, family members may dispute over who should inherit your assets. By having a will in place, you can help minimize these disputes and ensure that your wishes are followed.

Creating a will in Maryland is relatively straightforward, but it's important to work with an experienced estate planning attorney to ensure that your wishes are properly documented and legally binding. Here at The Law Offices of Bryan T. Pennington, we can assist you in achieving that goal.

<![CDATA[Auto accident?]]>Mon, 24 Apr 2023 17:13:57 GMThttp://bpenningtonlaw.com/blog/auto-accident Being involved in an accident can be a traumatic experience, but knowing what to do in the aftermath can help protect your rights and ensure that you receive the proper care and compensation. If you're in an accident in Maryland, here's what you should do:

  • Check for injuries: The priority is to check yourself and others for injuries. If anyone is injured, call 911 immediately for medical assistance.

  • Move to a safe location: If possible, move your vehicle to a safe location to avoid further accidents or injuries.

  • Call the police: Even if the accident is minor, it's important to call the police to file a report. The police report can serve as important documentation in any legal proceedings or insurance claims.

  • Exchange information: Exchange contact and insurance information with the other driver(s) involved in the accident, as well as any witnesses. This information will be necessary when filing an insurance claim.

  • Take photos: Take photos of the scene of the accident, including any damage to the vehicles involved, any injuries sustained, and any relevant road or weather conditions.

  • Contact your insurance company: Contact your insurance company as soon as possible to report the accident and begin the claims process.

  • Seek medical attention: Even if you don't feel injured immediately after the accident, it's important to seek medical attention. Some injuries, such as whiplash, may not become apparent until hours or even days after the accident.

  • Contact an accident lawyer: If you've been injured in the accident, it's important to contact The Law Offices of Bryan T. Pennington. We can help protect your rights and ensure that you receive the proper compensation for your injuries, lost wages, and other damages.

By following these steps, you can help protect yourself and ensure that you receive the proper care and compensation in the aftermath of an accident in Maryland. ]]>
<![CDATA[Stimulus Check sent to deceased relative.]]>Wed, 20 May 2020 03:03:26 GMThttp://bpenningtonlaw.com/blog/stimulus-check-sent-to-deceased-relativeAs an estate attorney, I have been asked numerous times about economic stimulus checks issued for people who have died. Unfortunately, the IRS feels that these checks must be returned. On May 6, 2020, they stated, “A Payment made to someone who died before receipt of the Payment should be returned to the IRS…” Below are the instructions provided by the IRS:

If the payment was a paper check:
1. Write "Void" in the endorsement section on the back of the check.
2. Mail the voided Treasury check immediately to the appropriate IRS location listed below.
3. Don't staple, bend, or paper clip the check.
4. Include a note stating the reason for returning the check.

If the payment was a paper check and you have cashed it, or if the payment was a direct deposit:
1. Submit a personal check, money order, etc., immediately to the appropriate IRS location listed below.
2. Write on the check/money order made payable to “U.S. Treasury” and write 2020EIP, and the taxpayer identification number (social security number, or individual taxpayer identification number) of the recipient of the check.
3. Include a brief explanation of the reason for returning the EIP.

For those living in Maryland, the address to send the checks is:

Andover Internal Revenue Service
310 Lowell St.
Andover, MA 01810
